Perennial Fraud.

Postby Foxy » Wed Oct 11, 2017 7:23 pm

Hi guys. Just a quick one.

Does the CPS prosecute Women for parental fraud?
Nothing related on their site that I can find.

Very relevant enquiry. Thanks for your thought in advance

is this about paternity fraud?

I expect that proving dishonesty would be a problem.

Hi yes. Sorry about that. Heads a little all over the place ATM.
Also known as misattributed paternity.

So if a fathers family name is given by the mother to the registrars office and the mother then informs someone else that they are the father, (verbally and via email) fraud would be hard to prove?

It would not obviously be fraud as such.

The registration involves a declaration which may be sworn, so a false declaration to the Registrar may be an offence.

My understanding was that the purported father should give positive consent before the registrar adds his name.

Further explanation or investigation required.

If established, a reference might well be made by the registrar, and wouldcarry more weight.

Thank you kind sirs. Have done quite a lot of reading about this and appears the cps would be reluctant to charge.

I suppose it's a matter of taking a 250k child support payments hit and moving on.

Never ceases to amaze me just how cruel the world can often be.

Thanks guys.

Why do you think that the CPS bringing a prosecution against the mother is your only means of being excused from liability for child support?

Not entirely sure itbat I understand the question. Liability? All child supports payment were paid in cash and ageeed between ourselves and without the child support agencies involment

With 27yrs between us and always having lived apart, it is clear that one has been taken to the cleaners for 14yrs simply becasue of missplacdd trust, a high pressure job and not paying attention to detail.

Boy, does one feel stupid!

Then you accepted liability. If it now turns out that you did so because you were misled about paternity then you *may* have grounds for an action. If there is a quarter of a million quid at stake then you should take professional advice from someone who can look at all of the circumstances; nobody here has enough information to advise you.

But that is a civil matter between the two of you. A potential prosecution of the other party is a distraction from that.
